Wood Valley Covenants: book 2609, pages 720-1

THIS DECLARATION, made this 17th day of April, 1978, by LEESVILLE DEVELOPMENT CORPORATION, a North Carolina corporation with its principal office in Wake County, North Carolina (hereinafter called "Declarant");

W I T N E S S E T H:

WHEREAS, the Declarant by instrument dated May 11, 1977, recorded in Book 2504, Page 494, Wake County Registry and amended by instrument dated January 31, 1978 and recorded in Book 2590, Page 601, Wake County Registry, subjected certain lots in Woodvalley Subdivision to the protective covenants therein set forth; and

WHEREAS, Declarant is the owner of the hereinafter described lots in Woodvalley Subdivision and desires to subject the same to the said protective covenants recorded in Book 2504, Page 494 as amended in Book 2590, page 601, of the Wake County Registry, each and all of which shall be for the benefit of such property and for each and every owner thereof, and shall insure to the benefit of and run with said property, and each and every lot or parcel thereof, and shall apply to and bind the successors in interest and any owner thereof.

NOW, THEREFORE, Declarant hereby declares that the real property described below is and shall be held, transferred, sold and conveyed subject to the protective covenants set forth in said Declaration recorded in Book 2504, Page 494 as amended in Book 2590, Page 601 of the Wake County Registry, North Carolina, said protective covenants being incorporated herein by reference:

Being all of Lots Nos. 43-62, inclusive; Lots Nos. 80-82, inclusive, Lots Nos. 99-111, inclusive; Lots Nos. 115-129, inclusive; Lot 164 and 33 as shown on map entitled "Woodvalley Subdivision, Wake Co., N.C., Section Three & Revision of Lot #33", dated January 26, 1978, prepared by Triangle Engineering, Architecture, Planning, Inc., and recorded in Book of Maps 1978, Page 59, Volume 1, Wake County Registry, North Carolina.
