This amendment to restrictive covenants, made this 31st day of
January. 1978, by LEESVILLE DEVELOPMENT CORPORATION, ROBUCK HOMES,
INC. AND CREECH CONSTRUCTION COMPANY, all North Carolina corporations
(hereinafter called "Declarants");
W I T N E S S E T H:
WHEREAS, Declarants are the owners of the majority of the lot shown
on maps of Woodvalley Subdivision in Book of maps 1976, Volume 4, Page
470, Wake County Registry and Book of Maps 1977, volume 2, Page 215,
Wake Comnty Registry, which lots are subject to restrictive covenants
recorded in Book 2504, Page 494, Wake County; and
WHEREAS, Declarants desire to amend said restrictive covenants as
hereinafter provided. NOW, THEREFORE, Declarants hereby amend said
restrictive covenants recorded in Book 2504, Page 494, Make County
registry as follows:
- Article V is amended adding at the end thereof the following: "Declarant
reserves the right to waive violations not in excess of 10% of the
set back requiremnts contained in this, Article V. Upon the
execution and recordation of such waiver or waivers, such violation
shall not thereafter be deemed existing."
- By reducing the side line setback requirements contained an
Article V from 20 feet to 16 feet with respect to Lot 57 of
Woodvalley Subdivision recorded in Book of Maps 1976, Page 470, Wake
County Registry.
- By adding at the end of Article XVI the following: "...then
owners of the lots has been recorded agreeing to change said
covenants in whole or in part."
- By adding the following additional protective covenants:
Leesville Development Corporation reserves the right to subject said
property to a contract with Carolina Power and Light Company for the
installation of undergxomd electric cables and/or the installation
of street lighting, either or both of which may require an initial
payment an/or a continuing monthly payment to Carolina Power and
Light Company by the owner of each lot.
